Livestock Organizations Request Re-hearing from EPA


Virtually all livestock organizations including the National Pork Producers Council, the U.S. Poultry and Egg Association, the American Farm Bureau Federation, National Cattlemen’s Beef Association, United Egg Producers and the National Producers Federation have petitioned the EPA for a re-hearing to provide an exemption from the Comprehensive Environmental Response Compensation and Liability Act (CERCLA) and the Emergency Planning Community Right to Know Act (EPCRA).


Previously the Environmental Protection Agency (EPA) provided exemptions with respect to CERCLA reporting by livestock operations.  Subsequently the U.S. Court of Appeals for the District of Columbia Circuit rejected the exemption which effectively imposes onerous reporting requirements on livestock operations which are inappropriate and have no environmental benefits.
